If you believe any store on zoozoz infringes on your intellectual property rights, we encourage you to contact us following the procedures outlined below.
A. Intellectual Property Infringement Reporting Procedures:
Our policy is to: (1) block access to or remove any content (including but not limited to text, graphics and photographs) that we believe in good faith infringes on the intellectual property rights of third parties (collectively, the “Content”) upon receiving a compliant notification; and (2) remove and cease providing services to repeat infringers.
If you believe that content on or accessed through the website constitutes copyright infringement, or that your intellectual property rights have been infringed in other ways, please send an infringement notice containing the following information to the designated agent listed below:
1. Specify the copyrighted work or other intellectual property that you claim has been infringed on or through the website, including the registration number of any such material (if applicable);
2. Specify the content that you claim infringes on an identified copyrighted work or other intellectual property right, including: (a) explaining how the material infringes on the copyrighted work or other intellectual property right; and (b) specifying the location of the material on the website and providing sufficient details to allow us to verify its presence on the website;
3. Your contact information, including your full name, mailing address, phone number, and email address;
4. You declare that you sincerely believe that any disputed use of a copyrighted work or other intellectual property right is not authorized by the copyright owner, their agent, or by law;
5. You warrant, by way of the penalty for perjury, that the information you provided in the notice is accurate and that you are the rights holder or have been authorized by the rights holder to act on their behalf;
6. Electronic or handwritten signature of a person authorized by the rights holder to act on his/her behalf.
B. Once the designated agent receives a compliant and genuine infringement notice:
Our policy is to remove or disable content that is suspected of infringing copyright.
C. Procedures for providing counter-notifications to the designated agent:
If we believe that the removed or blocked content does not infringe on any rights, or if we believe we have the right to publish and use the content from the rights holder, the owner's agent, or in accordance with the law (including fair use), we will send a counternotification containing the following information to the designated agents listed below:
1. Identify content that has been removed or disabled, including a description of where the relevant material appeared on the website before it was removed or disabled;
2. We declare that we are willing to bear the legal responsibility for perjury if there is any false statement. We sincerely believe that the deletion or blocking of this content is due to errors or misinterpretations of the relevant content.
3. Our contact information, including name, mailing address, telephone number, and email address;
4. We hereby declare that we agree to submit to the jurisdiction of the federal courts in the jurisdiction where our address is located;
5. Our electronic signature or physical signature.
If the designated agent receives a counter-notification, we may send a copy of the counter-notification to the original complainant, informing them that we may restore the removed content or lift the ban on the content within 10 business days. Unless the rights holder files a lawsuit seeking an injunction against the member, we may, at our discretion, decide whether to restore the removed content or restore access within 10 to 14 business days or longer after receiving the counter-notification.
Please note that under Section 512(f) of the Digital Millennium Copyright Act (DMCA), anyone who knowingly and falsely claims that content or activity constitutes an infringement may be liable for damages, including attorneys' fees.
